Environmental
& ESG

Brazil is the largest market in Latin America, with over two hundred million inhabitants and a plethora of natural resources that serve as inputs for agriculture and industry. It has one of the greatest biodiversities on the planet, if not the greatest, and consumers with a high demand for goods and services (including essential services such as sanitation and alternative energy sources). This scenario makes Brazil both a fertile environment for investments, given its potential for multiplying new businesses and expanding existing ones, and a jurisdiction with significant regulation on the environment and natural resources.
 

Therefore, our work encompasses both litigation (lawsuits, defenses against citations, etc.) and advisory services. Our consultancy related to Environmental and ESG (Environmental, Social, and Governance) matters prioritizes the use of legal intelligence as a tool to transform legal challenges into opportunities in various areas, such as carbon credits, geographical indications, reverse logistics, payment for environmental services, and protected genetic heritage.

Our Environmental & ESG department includes several examples of work already undertaken by our professionals in this regard, always with the focus of combining environmental and natural resource protection with the development of business activities and the pursuit of sustainable ventures.

Book: Environmental Liability: fundamentals and practical application.

This book corresponds to the author's master's thesis, with some editions. The central focus of the book is to analyze the liability of property owners and possessors, especially rural properties, both for the obligations of protection and restoration of deforested areas, and for compensation related to different types of environmental damage.

Our partners Gabriel Burjaili de Oliveira and J. Rubens Scharlack were part of a renowned team that prepared a guide on the main doubts surrounding the Brazilian legal-regulatory system in relation to jurisdictional REDD+* (*Reducing Emissions from Deforestation and Forest Degradation and other efforts) carbon credit programs. It is a vanguard initiative, which has contributed with several entities in the analysis of the theme, which only tends to grow in Brazil.

The text is focused on businesses in the wine sector, and addresses precisely how the legal system should encourage the adoption of value-adding and environmental protection mechanisms by owners, producers, and manufacturers.
